Détours Madagascar (hereinafter referred to as "the Local Agency"), whose website is published by Nomadays, is a travel agency and a tour operator based in ADJECTIVECOUNTRY, offering the creation and sale of tailor-made trips to DESTINATIONCOUNTRY via its website [www.voyagemadagascar.com] (https://www.voyagemadagascar.com) (hereinafter referred to as "the Site").

These General Terms of Use (hereinafter referred to as "GTU") are intended to apply exclusively between Nomadays, the Local Agency, and any person wishing to access the Site and/or use the services offered on the Site (hereinafter referred to as "the User").

Any use of the services offered via the Site implies full acceptance of these GTU. We invite you to read them carefully.

Please note that the provisions of these GTU may be modified, particularly due to legislative and/or regulatory changes, without Nomadays and/or the Local Agency being held responsible. Modifications will take effect upon publication on the Site (unless otherwise stated). Article 1: Legal Information

Article 2 : Definitions

The Site - refers to the website of the Local Agency published by Nowadays, accessible from the address: [www.voyagemadagascar.com] (https://www.voyagemadagascar.com)

User - any internet user who browses and/or uses the services offered by the Local Agency from the Site.

Services - all services offered by the Local Agency, namely travel services and associated services.

Client - any internet user who, after accessing the Site, (i) subscribes to the Newsletter, and/or (ii) requests a quote, and/or (iii) accepts a travel service proposal received from the Local Agency.

Article 3: Use of the Site

The Site is accessible free of charge from any location by any User with internet access. All fees incurred by the User to access the Services remain their responsibility. Likewise, the Local Agency cannot be held responsible for any internet connection issues attributable to any equipment and/or operator used by the User (such as reduced bandwidth or interrupted connection).

From the Site, Users have access to the following information and/or Services:

• A variety of travel offers for the country(ies) covered by the Local Agency (free access for all internet users);
• Detailed information on the various products and services offered by the Local Agency (free access for all internet users);
• A specific access to firmly or optionally book a trip or request an online quote;
• Access to a personalized space available to any Client with access codes.

Article 4: Warranty and Liability

Nomadays and the Local Agency will make their best efforts to ensure access to the Site 24/7, except in cases of force majeure or events beyond the control of Nomadays and the Local Agency, and subject to any necessary maintenance or breakdowns.

In fact, for the proper management of the Site, Nomadays and/or the Local Agency may at any time:

• Suspend, interrupt, or limit access to all or part of the Site, restrict access to the Site or certain parts of it;
• Remove any information that may disrupt its operation or contradict the applicable regulations;
• Suspend the Site for updates.

Nomadays and/or the Local Agency cannot be held liable in case of failure, malfunction, difficulty, or interruption preventing access to the Site or one of its features.

The equipment used to connect to the Site remains under the responsibility of the User, who must take all appropriate measures to protect their equipment and data, especially in the event of a virus attack via the internet. The liability of Nomadays and/or the Local Agency cannot be engaged, as the User remains solely responsible for the websites and data they access.

Article 5: General Obligations of the Site User

The User agrees to use the Site in accordance with the provisions of these GTU, public order, good morals, intellectual property rights, and image rights. Failure to comply with these provisions may result in Nomadays holding the User liable.

The User or Client must keep any login and password used to access the Site or any part of it strictly confidential, and must not allow anyone to access and use this login and password.

The User or Client is responsible for any activity related to the Services accessed or used via their Client Space. They must immediately notify Nomadays and/or the Local Agency of any unauthorized use of their login and password by sending an email to our Customer Relations service at: [email protected].

By using the Services, the User and the Client declare and guarantee that (a) all information provided is true and accurate; (b) they maintain the accuracy of this information; (c) their use of the Service does not violate any applicable law or regulation.

Article 6: Intellectual Property

All content and materials on the Services, such as texts, graphics, videos, audiovisual works, logos, photographs, icons, images, audio clips, and software, are the property of Nomadays and/or the Local Agency or its licensors and are protected by copyright laws in France and applicable international laws. The content and materials on the Site, operated, licensed, or controlled by Nomadays and the Local Agency, may not be copied, except by a User solely for personal use, and such content and materials may not be distributed, republished, downloaded, posted, or transmitted in any way without the prior written permission of Nomadays. Modifying or using the content or material for any other purpose would violate the intellectual property rights of Nomadays and/or the Local Agency and/or its licensors.

The name, brands, and logos of the Local Agency are registered trademarks and/or unregistered logos of the Local Agency (the "Trademarks" of the Local Agency) and are the property of the Local Agency. Unauthorized use of these Trademarks is prohibited by law. No part of the Service or GTU should be interpreted as granting, implicitly or otherwise, any license or right to use any Trademark displayed on this Service without the prior written consent of the Local Agency for each specific use. The use of any Trademark in a link to or from any website is prohibited without the prior written permission of the Local Agency.
